By purchasing our jewelry, engaging our services, commissioning a bespoke creation, booking an appointment, or accessing this website, you (“Client,” “you,” “your”) agree to the following Terms & Conditions (“Terms”, “Policies”).

These Terms form a binding legal contract between you and Maison Artisan.

Maison Artisan reserves the right to amend these Terms at any time. The version in effect at the time of your purchase or order will govern your transaction.

1. Definitions

• “Custom Order” — Any piece designed specifically for the client, including CAD renderings, bespoke jewelry, altered designs, unique diamond cuts, or personalized items.
• “General Warranty” — Maison Artisan’s lifetime inspection and cleaning services.
• “Maison Care Program” — Optional extended warranty plans offering enhanced servicing.
• “Center Stone” — Primary diamond or gemstone in a piece.
• “Accent Stones” — Pavé, halo, hidden halo, or micro-pavé stones, side accent-stones & all other.
• “Website” — maisonartisandiamonds.com and associated URLs.

2. Product Standards & Representation

All Maison Artisan creations are meticulously handcrafted. Slight variations in metal, angles, diamond positioning, or finishing are inherent to artisanal craftsmanship and are not considered defects.

Maison Artisan offers:

• Maison-cut lab diamonds
• Curated natural diamonds

Stone grading aligns with GIA/IGI standards but may vary slightly due to unique cutting characteristics.

Once a diamond or gemstone is approved—verbally, in writing, or electronically—it becomes:

• Final
• Non-refundable
• Non-exchangeable
• Reserved exclusively for your order (eligible for Lifetime Diamond Upgrade Program)

Market volatility and supplier binding agreements require all approvals to be treated as final.

Maison Artisan cannot guarantee the availability of any diamond or gemstone until payment is received.

3. Custom Orders, CAD Designs & Client Approvals

The following are considered custom and are final sale:

• Engagement rings
• CAD-designed creations
• Pieces with custom settings
• Modified designs
• Personalized engravings
• Unique diamond shapes or cuts
• Any design made specifically for the client

Clients are responsible for reviewing:

• Scale and proportions
• Measurements and diamond placement
• Width, height, and setting structure
• Gallery, basket, and shank details

CADs may not be to scale and serve as conceptual representations only.

CAD designs must be approved within 48 hours of delivery via email or message, if requested explicitly by the client.
If no written approval, modification request, or feedback is received within 48 hours:
The CAD is automatically deemed approved and authorized for production.

Once a CAD or design is approved (explicitly or automatically):

• It is final
• No changes may be made
• Production begins immediately

Once initial and final documents are reviewed and signed, Maison Artisan is not liable for:

• Design misunderstandings
• Client’s misinterpretation of CAD renderings
• Preference changes after approval
• Incorrect ring size provided by the client
• Requests for alterations post-approval

4. Payment, Taxes & Fees

Prices are listed in CAD. Pricing may change without notice due to:

• Metal market fluctuations
• Diamond industry changes
• Other company fees or policies

Clients are responsible for applicable taxes:

• Canada: HST/GST based on province
• USA: State duties & taxes upon import
• International: VAT, customs, import fees

Accepted:

• Major credit cards
• Bank wires
• Interac e-Transfer
• Verified international payments

Deposits for custom orders are strictly non-refundable.

5. Cancellation, Modification & Finality of Orders

Orders may only be cancelled:

• Within 24 hours
• Before diamond selection, CAD work, or production begins

Orders cannot be cancelled if:

• A diamond has been approved
• CAD work has begun
• Production has started
• The piece is custom or personalized

Once approval is given (explicit or automatic), no modifications can be made.

6. Shipping, Delivery & International Responsibilities

To guarantee safe and timely delivery, we work with several reliable, insured carriers. Orders may be shipped through but are not limited to:

• Canada Post
• FedEx
• UPS
• Purolator
• Additional secure domestic or international courier services as needed

The carrier used for your order will depend on your shipping address, order value, service availability, and insurance requirements.

Custom Orders & Bespoke Creations
Custom pieces—including engagement rings, wedding bands, and fully bespoke designs—require additional time for crafting, quality control, gem-setting, polishing, and packaging.
Typical timelines:

• Custom rings: 2–12+ weeks
• Fine jewellery (custom): 2–12+ weeks
• Revisions or special requests may extend timelines

You will receive regular updates during the creation process.

Shipping times vary by destination:
Within Canada

• Standard: 2–7 business days
• Express: 1–3 business days

United States

• Standard: 3–10 business days
• Express: 2–5 business days

International

• Standard: 5–14 business days
• Express: 3–7 business days
• Some countries may experience longer transit times due to customs handling

These estimates exclude processing time.

Final confirmation will be provided to each client at the time of inquiry or order, as availability may vary based on courier restrictions, insurance limitations, geopolitical conditions, and the value of the shipment.

Maison Artisan often provides complimentary international shipping (some exclusions apply).
Shipping fees may apply for:

• Some international destinations
• Remote or rural areas
• Expedited services
• Oversized or high-insurance-value shipments

Any applicable shipping fees will be discussed upon or after ordering or before shipping.

Once your order ships, you might receive:

• A shipping confirmation email when requested in written
• Tracking details from the carrier when requested in written
• Status updates until delivery when requested in written

Please allow up to 24 hours for tracking to activate after dispatch.

All parcels containing fine jewellery or diamonds are shipped:

• Fully insured until delivered (extra fee may apply to Oversized or high-insurance-value shipments)
• Safely packaged using discreet, unbranded external packaging
• Tracked and monitored throughout transit
• Signature-required for delivery (mandatory for all items)

We do not allow packages to be left unattended or delivered without verification.

For high-value shipments, the following may apply:

• Adult signature upon delivery
• Government-issued ID may be required by the carrier
• Packages cannot be re-routed to alternate addresses once shipped for security reasons
• PO Boxes may not be eligible for insured items depending on the carrier

Failure to be present for delivery may result in a redelivery fee or pickup from a secure facility.

For orders shipped outside Canada:

• Customs duties, import taxes, VAT, and brokerage fees may apply depending on your country’s regulations
• These fees are the responsibility of the recipient
• Maison Artisan has no control over customs charges or delays

We will provide necessary customs documentation for jewellery items, including declared value and material descriptions.

Maison Artisan is not responsible for:

• Delays caused by carriers
• Weather disruptions
• Customs inspections
• Incorrect or incomplete shipping information entered by the customer
• Force majeure events (natural disasters, strikes, etc.)

We will assist in tracking and resolving delays to the best of our ability.

A. Lost or Missing Parcels
If your package is marked as delivered but you did not receive it, we are not responsible but we may assist you:

• Contact us immediately, no later than 24hrs of delivery claim, at clientcare@maisonartisandiamonds.com
• We will initiate a trace or claim with the carrier
• Carrier investigations may take 7–21 business days

We will not issue replacements or refunds until the carrier completes its investigation.

B. Damaged Packages
If your parcel arrives damaged:

• 1. Photograph the packaging and jewellery immediately
• 2. Save all materials and contents
• 3. Contact us within 24 hours of delivery

We will file an insurance claim and guide you through next steps if necessary.

It is the customer’s responsibility to provide accurate shipping details.
Maison Artisan is not responsible for:

• Packages sent to an incorrect address provided at checkout
• Lost items due to address errors

If the order has not shipped yet, we will update the address upon request.
Once a package is in transit, changes are not allowed for security reasons.

Clients may have the option to pick up their jewellery from our Toronto boutique at:
Maison Artisan – 334 Adelaide St. W., Toronto
ID verification may be required for pickup.

If a parcel is refused, unclaimed, or repeatedly undeliverable:

• Return shipping fees
• Carrier handling fees
• Re-delivery fees

Custom and bespoke items are not eligible for refunds in these cases.

7. Returns & Exchanges

Due to the highly personalized nature of fine jewellery, all sales are final unless otherwise specified in this policy.
Most pieces at Maison Artisan are:

• Made-to-order
• Custom designed
• Created with specific stones, sizes, or engravings
• Crafted according to your consultation and approval

For this reason, we cannot accept returns or exchanges on custom or made-to-order items.

In rare cases defected items may be eligible for a one-time exchange, subject to approval.
To be eligible:

• The item must be unworn, unused, and in perfect, original condition
• All Maison Artisan packaging, certificates, and appraisals must be included
• The request must be made within 24hrs of delivery/in-person pickup
• The item must pass our quality inspection
• Exchanges are limited to items of equal or greater value

Maison Artisan reserves the right to refuse any exchange that does not meet these standards.

The following are final sale and not eligible for return, exchange, or refund:

• Custom-designed pieces
• Bespoke engagement rings and wedding bands
• Made-to-order jewellery
• Any item with engraving, personalization, or custom birthstones
• Any item resized, altered, or modified
• Loose diamonds or gemstones after client approval
• Items damaged, worn, or altered after delivery
• Promotional, discounted, or complimentary items
• Shipping fees, customs, duties, VAT, rush fees, CAD fees, or design retainers

This ensures fairness, transparency, and protection for both the client and the Maison.

We stand behind the excellence of our craftsmanship.
If you believe your item arrived defective or damaged, you must notify us within 24 hours of delivery with:

• Clear photos and/or videos of the issue
• Your order number and full contact information

Our Quality Assurance team will assess the piece. If an issue is confirmed, Maison Artisan will:

• Repair the item at no cost, or
• Replace it with a new one, at our discretion

Damage caused by intensional misuse, improper use, wear and tear, accidents, negligence, or unauthorized repairs is not covered.

Clients are responsible for:

• Return shipping fees
• Insured shipment costs
• Any duties, customs, VAT or taxes associated with the return/exchange

Maison Artisan is not liable for lost, stolen, or damaged returned parcels.
We strongly recommend using insured shipping via Canada Post, FedEx, UPS, Purolator, or another reliable courier.

Once a custom or bespoke order is placed and/or production has begun:

• The order cannot be cancelled
• The deposit or retainer is non-refundable
• Any design work (CADs, modifications, or stone sourcing) is considered a service and is non-refundable

This ensures fairness to both you and our craftsmen.

Maison Artisan offers resizing and aftercare services under the Maison Care Program, subject to the terms of your warranty tier.
If your ring requires resizing, please contact us before using any third-party jeweller. Unauthorized alterations void Maison Artisan warranty.

8. Warranty & Maison Care Program

• Lifetime semi-annual/ annual inspections
• Lifetime cleaning
• Prong tightening
• Minor refinishing during inspections

• Annual inspection mandatory
• Must be performed by Maison Artisan
• Third-party jeweler work voids warranty

Clients must ship jewelry to Toronto. Client covers:

• Shipping
• Duties
• Taxes
• Insurance

Not covered:

• Loss or theft
• Center stone damage
• Chips or cracks
• Wear-and-tear
• Chemical exposure
• Impact damage
• Any third-party jeweler work

9. Lifetime Diamond Upgrade Program

Only engagement ring center stones qualify.

Upgrade to:

• Larger diamond
• Higher value diamond
• Natural stone
• Colored diamond

• Original documentation
• Diamond in acceptable condition
• Upgrade value must be higher
• Craftsmanship fees apply

Maison Artisan may decline upgrades if stones show:

• Damage
• Alteration
• Missing documentation

10. Jewelry Care, Wear & Client Responsibility

By wearing jewelry, client accepts inherent risks associated with certain metals & skin/allergic reactions such as rash, burns etc as well as

• Scratching
• Metal wear
• Patina
• Bent prongs
• Stone loss from impact

Not covered:

• Impact damage
• Chemical or lotion exposure
• Deformation due to lifestyle

Maison Artisan is not responsible for incorrect sizes provided by the client.

Boutique Policy

At Maison Artisan, our boutique experience is designed to reflect the elegance, privacy, and exclusivity of our haute-joaillerie world. To maintain a refined and secure environment for all clients, the following policies apply to in-person visits at our Toronto boutique located at 334 Adelaide St. W.

Maison Artisan operates strictly on a private, by-appointment-only basis to ensure every client receives personalized, uninterrupted attention.

• Walk-ins are not permitted.
• Appointments must be booked in advance through our website, email, or official contact channels.
• Late arrivals may result in a shortened appointment to accommodate the next client.

For security and insurance compliance:

• Clients may be asked to provide a valid ID upon arrival.
• Appointments must be confirmed 24 hours prior; unconfirmed appointments may be cancelled.
• High-value consultations may require additional verification.

To ensure a comfortable and secure environment:

• A maximum of 2 guests may accompany the client unless otherwise approved.
• Children must be supervised at all times and may be restricted from certain areas for safety reasons.
• Pets are not permitted except certified service animals.

For the protection of clients, staff, and high-value inventory:

• The boutique is monitored by CCTV surveillance at all times (visual and auditory)
• Security personnel may be present during select appointments or after-hours bookings.
• Bags may be visually inspected if required by security protocols.

All surveillance footage is kept confidential and used solely for safety, fraud prevention, and legal compliance.

To protect both clients and inventory:

• Jewelry, diamonds, and custom pieces may only be handled under the supervision of a Maison Artisan specialist.
• Removal of gloves, cleaning cloths, or tools without permission is not permitted.
• Photography or videography of loose stones or proprietary designs may be restricted.

Custom consultations include:

• Education
• Design discussions
• CAD reviews
• Stone selection
• Sizing and measurement

During these visits:

• Design concepts, CAD files, renderings, and proprietary artwork remain the exclusive intellectual property of Maison Artisan.
• No recording, photographing, or copying of digital or printed designs is permitted until purchase or written approval.

The boutique accepts the following secure payment methods:

• Visa
• Mastercard
• Major Canadian & International Banking Institutions (where supported through our processors)
• Certified bank draft or wire transfer (for high-value pieces)

All payments are processed through encrypted, secure systems.

Clients receiving their final jewelry piece in-person will have:

• A full inspection opportunity
• Stone verification
• Mounting and setting review
• Sizing confirmation

Once the piece leaves the boutique, any changes (resizing, tightening, adjustments) fall under our Maison Care or applicable warranty program.

To respect all clients’ time:

• Cancellations require 24 hours’ notice.
• Appointments rescheduled more than twice may require a deposit.
• Repeated no-shows may result in restrictions on future bookings.

Clients are expected to maintain a respectful, courteous, and professional conduct while in the boutique.
Maison Artisan reserves the right to refuse service or end an appointment early if:

• Behavior is disruptive, unsafe, or inappropriate
• Policies are not followed
• Security concerns arise

Maison Artisan is not responsible for:

• Loss or theft of personal belongings
• Damage to personal jewelry brought in for discussion unless accepted for servicing under a signed intake form

Personal pieces brought for comparison or inspiration must be checked in and documented.

Maison Artisan reserves the right to update our Boutique Policy at any time to ensure safety, security, and the highest quality of service.

11. Privacy & Data

Maison Artisan complies with all privacy regulations.
Client data is used for:

• Orders
• Communication
• Appointments
• Service history

Never sold or shared.

12. Intellectual Property

All designs, CADs, trademarks, photography, written content, and proprietary diamond cuts are the exclusive property of Maison Artisan.
Reproduction or duplication is strictly forbidden.

13. No Reliance on Verbal Statements

Only written documentation, CADs, invoices, and signed agreements are binding.
Verbal statements or informal communication are not guarantees.

14. Indemnification (Lawsuit Protection)

Client agrees to indemnify, defend, and hold harmless Maison Artisan from any claims, legal costs, damages, or losses arising from:

• Misuse of jewelry
• Failure to follow care instructions
• Third-party jeweler work
• Incorrect ring size provided
• Shipping delays
• Customs complications
• Stone damage due to wear
• Miscommunication outside formal documentation
• Failure to attend annual inspections

This clause survives the transaction.

15. Limitation of Liability

Maison Artisan’s maximum liability is limited strictly to the purchase price of the item.
Maison Artisan is not liable for:

• Indirect, incidental, special, consequential damages
• Emotional distress
• Loss of use
• Business interruption
• Insurance deductibles
• Lost stones
• Loss due to theft

16. Force Majeure

Maison Artisan is not responsible for delays or inability to fulfill obligations caused by:

• Natural disasters
• War, terrorism, conflict
• Global emergencies
• Supply chain issues
• Government restrictions
• Transportation shutdowns
• Weather delays

17. Dispute Resolution & Governing Law

Governed by the laws of Ontario, Canada.
All disputes must be resolved in Toronto, Ontario courts.

Binding arbitration under the AAA (American Arbitration Association).
Class action waivers apply.

Unless prohibited by law, disputes fall under Ontario, Canada jurisdiction.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

18. Severability

If any clause is unenforceable, the remaining provisions remain in effect.

19. No Waiver

Failure to enforce a clause does not constitute a waiver of future rights.

20. Entire Agreement

These Terms automatically constitute the complete agreement between Maison Artisan and the client.
